Preliminary Information Form

This Preliminary Information Form (“Form”) constitutes an integral part of the Distance Sales Agreement (“Agreement”). Terms capitalized in this Form shall have the meanings assigned to them in the Agreement.

This Form has been prepared for the purpose of providing preliminary information, in accordance with the provisions of the Law and the Regulation, regarding the sale and delivery of the Product sold to you by the Seller, whose characteristics and sales price are specified on the Site and below. Please read this Form carefully. By confirming your order, you acknowledge that you will enter into the payment obligations specified below in relation to the Product subject to the order.

By electronically confirming and accepting this Form, you confirm and acknowledge that, prior to the conclusion of the Agreement, you have fully and accurately obtained the information contained herein, including but not limited to the Seller’s contact details, the basic features of the Product, the total price of the Product including taxes, and the payment and delivery details that are required to be provided to you by the Selle

In order to make payments through the Site, your card must be enabled for online transactions. The Paratika security system is used for purchases made by card. If the cost of the remote communication tools used during the conclusion of the Agreement exceeds the standard tariff rates, you will also be responsible for such additional costs.

5. DELIVERY

The Product shall be delivered to you or to a third party designated by you within the period specified on the Site, depending on the distance to your place of residence, provided that it does not exceed the legal limit of 30 (thirty) days.

For domestic purchases, the Product is shipped free of charge.

6. RIGHT OF WITHDRAWAL

A. Exercise of the Right of Withdrawal

You may exercise your right of withdrawal from the Agreement by notifying the Seller in writing or via a durable data storage device, without providing any justification and without incurring any penalty, within 14 (fourteen) days from the date the Product is delivered to you or to the third party designated by you.

B. Return Procedure in Case You Exercise Your Right of Withdrawal

You must send the Product to our return address, or return it at Seller stores, within 14 (fourteen) days from the date on which you notify the Seller of your exercise of the right of withdrawal. Otherwise, your right of withdrawal will expire.

Upon receipt of your withdrawal notice, if you choose to return the Product by courier, a return code will be provided to you by Yurtiçi Kargo. Please send the Product you wish to return via Yurtiçi Kargo Servisi A.Ş. You may complete the shipment by adding the return code in the “Buyer” field.

C. Refund of the Product Price

If you deliver the Product subject to the right of withdrawal to Yurtiçi Kargo Servisi A.Ş., the carrier we have designated for returns, all your payments will be refunded within 14 (fourteen) days from the date of delivery to the carrier. If you return the Product using a different carrier, the Product price will be refunded within 14 (fourteen) days from the date the Product reaches us. If you exercise your right of withdrawal before the Product is delivered to you, all your payments will be refunded within 14 (fourteen) days from the date on which you notify us that you are exercising the right of withdrawal.

D. Return Costs

If the return is made via Yurtiçi Kargo Servisi A.Ş., the carrier designated by the Seller, the Buyer shall not be held responsible for return costs. If the designated carrier does not have a branch in the Buyer’s location, the Seller shall accept the return of the Product without requesting any additional costs. If requested by the Buyer, the return cost may be deducted from the refund amount or from the delivery costs.

E. Return Obligations

If you exercise your right of withdrawal, (i) the invoice of the Product delivered to you or to the third party you have designated must be returned (if the invoice of the Product to be returned was issued to a company, the return must be made together with a return invoice issued by that company. Returns of orders invoiced to companies cannot be completed unless a return invoice is issued), (ii) the return form, and (iii) the Product to be returned, including its box, packaging, and any accessories, must be delivered in full and undamaged.

F. Damages and Campaigns Arising from the Exercise of the Right of Withdrawal

If a decrease in the value of the Product occurs due to a reason arising from your fault, or if the return becomes impossible, you shall immediately and fully compensate the Seller for any damages incurred in proportion to your fault and shall keep the Seller indemnified against such damages.

If the exercise of the right of withdrawal causes the total amount to fall below the campaign threshold set by the Seller, the discount previously granted under the campaign shall be cancelled.

G. Products Excluded from the Right of Withdrawal

For Products that are prepared in line with your requests or clearly personal needs, or which are not suitable for return due to their nature, or which are not appropriate to be returned for health or hygiene reasons (including but not limited to single-use products and cosmetic products), the right of withdrawal cannot be exercised if protective elements such as the packaging, tape, seal, or wrapping have been opened. This is in accordance with the Regulation.

7. APPLICABLE LAW AND DISPUTE RESOLUTION

This Agreement shall be governed by and interpreted in accordance with the laws of the Republic of Turkey.

Without prejudice to the Parties’ rights under the Enforcement and Bankruptcy Law No. 2004, in the resolution of disputes arising from or related to this Agreement, the Consumer Arbitration Boards located in the Buyer’s place of residence or where the Product was purchased shall have jurisdiction within the monetary limits announced each December by the Ministry, and for disputes exceeding these monetary limits, the Consumer Courts shall have jurisdiction.
