These TERMS OF USE (“Terms”) have been prepared by Quantum Aesthetics Kozmetik Anonim Şirketi (“Quantum”), whose details are provided below, for individuals (“User”) who visit the website or mobile application at https://www.quantumaesthetics.com (“Site”), for the purpose of the remote marketing of various products belonging to Quantum.

2. Purpose of Site Use

2.1 Through the Site, various cosmetic products and other products and services in areas such as hair care and eyelash care are marketed and offered for sale by Quantum. These Terms have been created solely for the purpose of the User visiting the Site and viewing the services offered by Quantum and do not constitute a distance sales agreement.

2.2 The User may only make purchases on the Site in the capacity of a consumer. For Users who are not considered consumers with respect to their transactions carried out on the Site, the provisions of the Turkish Commercial Code No. 6102 shall apply. By becoming a member of the Site and placing an order, the User acknowledges and declares that the transaction does not serve a commercial purpose; otherwise, the User will not be entitled to consumer rights, and Quantum may terminate their membership and cancel their orders.

3. Scope and Conditions of Membership

3.1 Membership to the Site is free of charge. Users can benefit from the services offered by Quantum and place orders only by creating a membership account. Orders cannot be placed without creating a membership.

3.2 By giving electronic approval through the Site, the User accepts all terms and conditions of these Terms and the Membership Agreement. Upon completion of the approval process, a User account is created, and the User gains the right to place orders through the Site.

3.3 Quantum reserves the right to reject a User’s membership application, suspend the existing membership, or cancel it entirely, at its sole discretion and without the obligation to provide any justification.

4. User Rights and Obligations

4.1 Accuracy and Currency of Information

The User declares that all information provided during registration to the Site is accurate, complete, and up to date. The User is responsible for keeping this information current and shall immediately make the necessary updates through the Site in the event of any changes. The User shall be solely responsible for any damages, liabilities, or legal consequences arising from the provision of inaccurate, incomplete, or outdated information.

4.2 Account Security and Unauthorized Access

The User may not share their password or login credentials with third parties. The User is responsible for ensuring the security of their account and shall be held liable for all actions taken through their account, as well as for any damages arising from unauthorized access or use.

4.3 Legal and Ethical Use

The User shall use the Site only in compliance with legal and ethical rules. The User shall not engage in spam, creation of fake accounts, use of bots, fraud, or similar violations. If Quantum detects such violations by the User, it may suspend or cancel the User’s account and pursue legal remedies. In the event that Quantum suffers damage due to the User’s unlawful actions, Quantum reserves the right to seek recourse from the User for all direct and indirect damages, including compensation, legal fees, and defense costs.

4.4 Payment Obligations

The User shall make payments through the Site fully and on time. The User shall provide accurate and complete information during the payment process. Quantum shall not be held liable for any payment issues arising from incomplete or incorrect information provided by the User.

4.5 Liability

The User acknowledges that Quantum shall not be liable for any damages or losses — including but not limited to direct, indirect, incidental, special, punitive, or consequential damages — that may arise during the use of the Site or in connection with transactions carried out through the Site.

4.6 Intellectual Property

The User may not copy, reproduce, modify, share with third parties, distribute, or use for commercial purposes any content on the Site — including product display photos, descriptions, formulations, ingredient information, production methods, or any information that constitutes intellectual property — without Quantum’s prior written consent. The User shall not attempt to reverse-engineer, analyze, or deconstruct the content related to the cosmetic and hair care products offered by Quantum, nor develop derivative products from them.

4.7 Notification and Communication

The User shall keep the e-mail address provided during registration up to date and shall receive and follow notifications sent by Quantum. Any notification sent by Quantum to the e-mail address provided by the User shall be deemed to have been received by the User.

4.8 Third-Party Links

The Site may contain links directing users to other websites or content that are not under the control of Quantum and are owned or operated by third parties. Quantum does not provide any guarantee regarding the content, security, accuracy, or currency of the linked websites and cannot be held responsible for the services or content offered on such sites.

5. Quantum’s Rights and Obligations

5.1 Quantum shall take the necessary measures to ensure the operation, maintenance, and security of the Site. However, Quantum shall not be held responsible for the temporary unavailability of the Site due to technical malfunctions, maintenance work, interruptions caused by internet infrastructure, or force majeure events. Quantum shall make reasonable efforts to resolve such disruptions as quickly as possible.

5.2 Quantum may verify the accuracy of the information provided by the User and may share such information with authorized public institutions, payment service providers, and third-party service providers for verification purposes. In the event that misleading information is provided, Quantum reserves the right to suspend or cancel the User’s membership.

5.3 Quantum reserves the right to modify, update, or revise the service terms, prices, and the provisions of these Terms without prior notice. Such changes shall become effective as of the date they are published on the Site. If the User does not accept the changes, the User has the right to terminate their membership.

6. Protection of Personal Data

6.1 Quantum processes and stores the User’s personal data in accordance with the Law on the Protection of Personal Data No. 6698 (KVKK). The User may access detailed information regarding the processing of personal data through Quantum’s Privacy Notice and Cookie Policy available on the Site.

6.2 The User acknowledges that credit card and other financial information provided during payment transactions may be shared with relevant payment service providers and financial institutions for the purpose of processing the transaction.

6.3 Quantum may use cookies and other tracking technologies to enhance the User experience. The User may manage their cookie preferences through the Cookie Policy provided on the Site.

7. Termination of Membership

7.1. The User may cancel their membership at any time. Upon cancellation, the User’s account will be permanently closed, and the User will lose the right to place orders through the Site.

7.2. Quantum reserves the right, when deemed necessary, to reject a User’s membership application, suspend an existing membership, or permanently terminate it without being required to provide any justification.

7.3. In the event that either the User or Quantum terminates the membership, the Membership Agreement shall automatically cease to be in effect. The termination of the Membership Agreement shall not eliminate any rights or obligations that arose prior to the date of termination. Quantum may retain any data it deems necessary for the legally required period, in accordance with applicable legislation.

8. Other Provisions

8.1 Evidence Agreement

The User accepts that, in any dispute arising from the Membership Agreement, Quantum’s official books and commercial records, as well as electronic data, computer records, and audio recordings stored in its databases and servers, shall constitute valid evidence, and that this clause constitutes an evidence agreement within the meaning of Article 193 of the Turkish Code of Civil Procedure.

8.2 Commercial Electronic Messages

The User may, in addition to approving the Membership Agreement, give electronic consent via the Site for Quantum to send commercial electronic messages for the purposes of promoting and marketing its products, announcing its business, or increasing brand awareness through content such as greetings and celebratory messages. The User may withdraw this consent or refuse to give it at any time by contacting Quantum through the available communication channels. However, messages regarding changes, usage information, or maintenance processes related to a product purchased by the User do not fall under the scope of commercial electronic messages and may be sent without additional consent.

9. Governing Law and Dispute Resolution

These Terms shall be governed by and interpreted in accordance with the laws of the Republic of Turkey.
