As Quantum Aesthetics Kozmetik Anonim Şirketi (“Quantum” or “We”), duly established under the laws of the Republic of Türkiye and registered with the Istanbul Trade Registry under number 381977-5, located at Caddebostan Mahallesi Bağdat Caddesi Köksal Apartmanı No:317 Daire:9 Kadıköy / Istanbul, we attach utmost importance to the protection of your personal data processed through the website https://www.quantumaesthetics.com/ (“Site”).

We respect your rights regarding the confidentiality of your personal data and take our responsibilities concerning the processing of such data seriously. We do not collect or process personal data unnecessarily. By becoming a member of the Site, you acknowledge and confirm that you have read and accepted the Terms of Use, the Privacy Notice, and this Personal Data Protection Notice.

This Privacy Policy and Information Notice has been prepared in accordance with Article 10 of the Personal Data Protection Law No. 6698 (“KVKK”) and the Communiqué on the Principles and Procedures to Be Followed in Fulfilling the Disclosure Obligation, published in the Official Gazette dated 10.03.2018 and numbered 30356. It aims to inform our visitors and customers about the processing of personal data during their visit to the Site.

1. Who is the Data Controller?

Unless otherwise agreed with you, Quantum Aesthetics Kozmetik will act as the data controller. We process, transfer, store, and delete the personal data provided by our employees, job applicants, former employees, shareholders, company representatives, suppliers, customers, and visitors in accordance with the Law on the Protection of Personal Data (“KVKK”). Your personal data may be processed, stored, deleted, and disclosed/transferred to third parties only to the extent permitted by relevant legislation, in line with honesty and legal principles, and limited to the purposes specified below.

2. Personal Data We Process and Collection Methods

Under KVKK, personal data refers to any information relating to an identified or identifiable natural person. The following categories of personal data are collected and processed by Quantum Aesthetics Kozmetik through the Site, telephone/mobile/internet channels, customer interactions, written or digital applications submitted to Quantum Aesthetics Kozmetik, as well as through electronic, verbal, or physical means. These data are processed using automated or non-automated methods, limited and proportionate to the purposes specified below and in accordance with KVKK and related data protection regulations.

3. Purpose of Processing Your Personal Data

Quantum Aesthetics Kozmetik processes personal data specified in Article 2 (Personal Data and Collection Methods) for the performance of a contract, the legitimate interests of the data controller, and without harming your fundamental rights and freedoms, for the following purposes:

(i) Ensuring compliance with laws and regulations;

(ii) Managing contractual processes;

(iii) Preventing, identifying, and resolving system issues, errors, and unauthorized/malicious access attempts;

(iv) Responding to your questions, requests, suggestions, and complaints;

(v) Managing financial and accounting processes related to payments;

(vi) Reviewing and auditing payment transactions;

(vii) Managing logistics operations;

(viii) Executing product purchases, after-sales support, and sales processes;

(ix) Contacting users regarding their accounts and transactions;

(x) Reviewing and auditing business operations;

(xi) Following up on requests/complaints and improving processes and customer experience;

(xii) Conducting communication activities and customer satisfaction surveys;

(xiii) Ensuring platform security against unauthorized and malicious activities;

(xiv) Managing IT and information security operations;

(xv) Ensuring legal and commercial security.

Quantum Aesthetics Kozmetik processes the personal data specified in Article 2 (Personal Data and Collection Methods) on the legal basis that such processing is necessary for compliance with a legal obligation to which the data controller is subject, or for the establishment, exercise, or defense of legal claims, as well as for the protection and enforcement of our rights and for the management of legal proceedings in the event of a legal dispute.

(i) Fulfilling obligations under Law No. 5549 on the Prevention of Laundering Proceeds of Crime and related regulations regarding user identity verification and reporting suspicious transactions;

(ii) Verifying identity information to complete account creation;

(iii) Preventing fraud and money laundering;

(iv) Responding to information and document requests from authorized public institutions and organizations;

(v) Managing legal processes, including enforcement proceedings, notifications, lawsuits, and documentation.

Quantum Aesthetics Kozmetik processes the Marketing Data specified in Article 2 (Personal Data and Collection Methods) based on your explicit consent, primarily for the following purposes.

(i) Conducting marketing analysis;

(ii) Managing advertising, campaign, and promotional processes;

(iii) Conducting product/service marketing activities;

(iv) Carrying out customer satisfaction initiatives.

4. Transfer of Your Personal Data

The personal data of customers may be shared with the authorized representatives of Quantum Aesthetics Kozmetik, its affiliates, business partners, suppliers, shareholders, legally authorized public authorities and institutions, and private entities, within the scope of the personal data processing conditions and purposes set forth under Articles 8 and 9 of the Law.

Such data may be shared for the purposes of enabling the relevant business units to carry out the necessary activities to ensure that data subjects can benefit from the products and services offered by Quantum Aesthetics Kozmetik, executing the related business processes, conducting the commercial activities carried out by Quantum Aesthetics Kozmetik, performing the necessary work by the relevant business units and executing the associated business processes, planning and implementing Quantum Aesthetics Kozmetik’s commercial and/or business strategies, ensuring the legal, technical, commercial and operational security of Quantum Aesthetics Kozmetik and the relevant persons who maintain a business relationship with Quantum Aesthetics Kozmetik, and planning and carrying out the activities necessary for customizing and promoting the products and services offered by Quantum Aesthetics Kozmetik according to the preferences, usage habits and needs of the relevant persons.

5. Security Measures

5.1 Quantum Aesthetics Kozmetik is required under KVKK Article 12 to take all necessary technical and administrative measures to prevent unlawful processing of personal data, unauthorized access, and to ensure secure retention of personal data.

5.2 We will retain your personal data for as long as necessary to fulfil the purposes for which it was collected, including any legal, accounting, or reporting requirements. This means that the retention period of your personal data may vary depending on the type of data collected. In determining the appropriate retention period, we take into account the amount, nature, and sensitivity of the data, the potential risk of harm from unauthorized use or disclosure, the purposes for which we process the data and whether those purposes can be achieved through other means, as well as applicable legal requirements. 6. Your Rights Under KVKK Article 11

You may exercise the following rights regarding your personal data by submitting a request to Quantum Aesthetics Kozmetik:

(i) To learn whether your personal data is processed;

(ii) To request information about the processing of your personal data;

(iii) To learn the purpose of processing and whether your personal data is used for that purpose;

(iv) To learn the third parties to whom your personal data is transferred domestically or abroad;

(v) To request deletion or destruction of your personal data under Article 7 of KVKK;

(vi) To request notification of corrections or deletions to third parties to whom the data has been transferred;

(vii) To object to unfavorable results arising from automated data processing;

(viii) To request compensation if your personal data is processed unlawfully and you suffer damages.

Your request will be finalized free of charge as soon as possible and no later than 30 days.

If your request requires additional cost, a fee may be charged according to the tariff determined by the Personal Data Protection Authority.
